Control of legionella bacteria in hot and cold water systems

This notice is to remind duty holders of the requirement to identify and assess sources of risk for legionella bacteria in hot and cold water systems, and take steps to prevent or control the risk by putting adequate controls in place and maintain and monitor those controls to ensure effectiveness.

This follows recent inspections of offshore installations, which have identified significant failings in the control of legionella bacteria in hot and cold water systems and resulted in formal enforcement action being taken against the duty holders concerned.

Manchester care home fined over Legionnaires’ risk

A care home company has been fined £5,000 after putting elderly residents in Manchester at risk of catching Legionnaires’ disease.

SJ Care Homes Ltd was prosecuted by HSE after the company failed to comply with an enforcement notice issued at one of its nursing homes.

Director fined for neglecting legionella risk

The managing director of a Black Country firm has been fined after neglecting to control legionella at its site.

Despite warnings from water treatment contractors, Ernest Jones of Coseley-based First Metal Finishers Ltd failed to put a management system in place for the control of legionella.

Company fined for inadequate legionella assessments at Welsh care homes

HSE is warning companies responsible for carrying out legionella surveys on water systems of the need to ensure that their work is thorough and accurate.

The warning follows the conviction of a Berkshire-based water treatment company for carrying out inadequate and misleading surveys at nursing homes in Blaenau Gwent and Powys.

Health warning after Lancashire workers catch legionnaires’ disease

HSE has warned companies in Lancashire to ensure they carry out regular, simple checks to protect employees from Legionnaires’ disease.

The warning follows the prosecution of butchery processing company Kepak UK Ltd after two employees caught the disease at Kepak’s Carr Place premises on the Walton Summit Industrial Estate, Bamber Bridge, Preston.

Crown censure of HM prison service

HSE called HM Prison Service to its Nottingham office on 12 June 2009 to answer a Crown censure, arising from a case of Legionella at Nottingham Prison in 2006.

Whilst criminal proceedings cannot be taken against the Crown, administrative procedures, known as Crown censures, are used in circumstances where it is HSE’s opinion that, but for Crown immunity, there would have been sufficient evidence to provide a realistic prospect of conviction in the courts.
